Goods Return and Refund Policy
Preliminary Provision
This document, referred to herein as the "Goods Return and Refund Policy" (the "Policy"), sets forth the conditions under which customers ("Customers") may return and obtain refunds for goods purchased from Padelsouq FZE (the "Company"). This Policy is applicable to purchases made within the United Arab Emirates ("UAE") and internationally. The terms outlined in this Policy govern the contractual agreement between the Company and its Customers concerning the return and refund of goods.
Section 1: Domestic Returns within the UAE
Article 1.1: Return Period
Customers shall initiate the return of goods within one (1) calendar day from the date of receipt, as evidenced by the delivery confirmation provided by the Company.
Article 1.2: Charges for Return Shipping
A fixed charge of AED 10 will be levied for each item returned. This charge shall be borne by the Customer.
Article 1.3: Restocking Fee
A restocking fee, calculated as 1% of the total purchase price of the returned item, shall be applied.
Article 1.4: Exclusion from Return and Refund
Goods designated as "final sale" , "clearance sale" or "offers", are not eligible for return or refund under any circumstances. The sale of such goods is considered final and binding upon transaction completion.
Article 1.5: Method of Refund and Timing
Refunds shall be processed exclusively in the form of in-store credit, which remains subject to the availability of such credit at the time the refund is initiated. The issuance of said in-store credit shall occur within a maximum period of fifteen (15) calendar days from the date on which the Company receives the returned goods compliant with the conditions stipulated under this Policy. This timeframe encompasses all necessary administrative processes required to finalize the refund.
The Company shall not be held liable for any delays beyond the specified period that are attributable to circumstances beyond its reasonable control. This clause is to be interpreted in accordance with the general principles of force majeure under the governing laws of the United Arab Emirates.
Article 1.6: Non-Returnable Goods
Specific categories of goods shall be exempt from return or exchange. These include, inter alia, Padel Rackets, customized products, special orders, personalized items, personal care products (including socks and sports bras), goods purchased during a sale, and gift cards.
Section 2: International Returns
Article 2.1: Timeframe for Return
International Customers are required to initiate returns within one (1) calendar day subsequent to receipt.
Article 2.2: Liability for Return Shipping Costs
International Customers are exclusively responsible for all costs associated with the return of goods.
Article 2.3: Refund Methodology and Processing Timeframe
Refunds attributable to international transactions shall be executed exclusively in the form of in-store credit, consistent with and subject to the stipulations detailed within this Policy. The procedural mechanics of such refunds adhere strictly to the outlined provisions, ensuring compliance and uniformity with the established return and refund protocol.
It is imperative to note that the processing of refunds, culminating in the issuance of in-store credit for international returns, shall occur within a stipulated period not exceeding fifteen (15) calendar days subsequent to the receipt of the returned merchandise by the Company. This period encompasses all necessary procedural steps required to validate the return and execute the refund in accordance with the terms herein.
This timeframe is established to provide clarity and predictability to the refund process, acknowledging the complexities inherent in international transactions. The Company commits to adherence to this timeline, barring unforeseen circumstances and delays outside its reasonable control, which may impact the processing time.
By instituting this structured approach to refunds, the Company aims to maintain a transparent and efficient process, promoting trust and consistency in international trade practices. This provision is an integral component of the overarching Policy, underscoring the Company's commitment to uniformity in its return and refund mechanisms globally.
Article 2.4: Exchange Policy
The conditions applicable to goods exchanges are concomitant with those stipulated for domestic and international returns under this Policy.
General Provisions
Article 3.1: Inquiry
Customers seeking clarification concerning the eligibility of items for return or exchange shall direct their inquiries to the Customer Service Department of the Company.
Article 3.2: Modification of Policy
The Company reserves the unimpeded right to amend, modify, or otherwise alter this Policy at any given time without prior notice to Customers. Such modifications shall take immediate effect upon their publication on the Company’s official website or dissemination through other official communication mediums.
Article 3.3: Governing Law
This Policy shall be governed by and construed in accordance with the statutes and laws of the United Arab Emirates. Any disputes arising hereunder shall be adjudicated in a court of competent jurisdiction within the UAE.
Concluding Provision
This document is intended to articulate the parameters and conditions governing the return and refund of goods in a manner that is explicit and bereft of ambiguity, thereby fostering a clear understanding between the Company and its Customers. Compliance with this Policy is mandatory following the purchase of goods from the Company.
